Abstract

The TRIPS Agreement provides that all member states must protect plant varieties either by patents or by an effective sui generis system. Developing country member states have traditionally refrained from imposing intellectual property right protection in the field of agriculture and consequently bear the burden of adjustment to this new requirement. This article analyses the conceptual, legal and institutional framework upon which plant variety protection is premised. It examines African states' efforts towards fulfilling their obligations in this field and compares this to the Indian situation where much more work has been carried out. The last section provides the lineaments of a sui generis system for plant variety protection.
