Abstract

The «antiquarian» scholars of the eighteenth century were the first to be interested in the medieval family, and this interest continued in the «historical school of law» only to wither away in a positivistic classification of the institutions of private law abstracted from the social context in which they existed. Sociology was the first discipline to overcome this isolation, but with little philological rigour. Then political history, through genealogical and prosopographical analyses, attempted to assess the public order which developed in the Middle Ages to the benefit of the families of the ruling class and family alliances. Finally, an attempt is being made today to simultaneously revive genealogical and legal studies and to combine them with demographic and topographic research into families in a form of social history which is rigorously linked to political history.
