Abstract

Der EuGH ergänzt seine Phil Collins-Entscheidung (JZ 1994, 142) um die rückwirkende Anwendung des Diskriminierungsverbots in Art. 12 I EG auf ausländische Urheber, die vor Inkrafttreten des EWGV bereits verstorben waren. Schack (JZ 2002, 887) hält dies für konsequent, wenngleich für unter Vertrauensschutzgesichtspunkten grundsätzlich bedenklich.
